Terms of purchase and license for the Gay Lee's Gift Certificates.

Gift Certificate Terms and Conditions of Purchase

1. Redemption. Gift Certificates must be redeemed toward the purchase of eligible products or services. Purchases are deducted from the Gift Certificate balance. Any unused balance will be stored in the recipient's Gift Certificate account until redeemed. If purchase exceeds the amount of the Gift Certificate, the balance must be paid with a credit card or other usual payment method at time of purchase. Gay Lee Gulbrandson will provide Gift Certificate purchasers with information about the redemption status of Gift Certificates that they purchase, within 48 months of the purchase. To obtain Gift Certificate balances, send an email request to Info@VodderMLD.com.

2. Modifications. Gift Certificates cannot be resold, transferred for value, redeemed for cash or applied to another account, except to the extent required by law. Unused Gift Certificate balances may not be transferred.

3. Risk of Loss. The risk of loss and title for Gift Certificates pass to the purchaser upon transmission to the purchaser or recipient, whichever is applicable. If a Gift Certificate is lost, stolen, or destroyed, and Gay Lee Gulbrandson is notified before its redemption, every effort will be made to honor the unused balance. Gay Lee Gulbrandson is not responsible if a Gift Certificate is lost, stolen, destroyed or used without permission.

4. Fraud. Gay Lee Gulbrandson reserves the right to close customer accounts and bill alternative forms of payment if a fraudulently obtained Gift Certificate is redeemed and/or used to make purchases on www.VodderMLD.com, or in person.

5. Disputes. Any dispute relating in any way to Gift Cards/Certificates in which the aggregate total claim for relief sought on behalf of one or more parties exceeds $7,500 shall be adjudicated in any state or federal court in Alameda County, California, and you consent to exclusive jurisdiction and venue in such courts.

6. General Terms. When you purchase, receive or redeem a Gift Certificate, you agree that the laws of the State of California, without regard to principles of conflict of laws, will govern these Gift Certificate terms and conditions. Gay Lee Gulbrandson reserves the right to change these terms and conditions from time to time in her sole discretion. All terms and conditions are applicable to the extent permitted by law.

7. Expiration Date. Gift Certificates have no expiration date. From a practical point of view, keeping a Gift Certificate longer than 3 years risks loss of verification data due to changes in record-keeping methods or systems.

8. Limitation of Liability. The SELLER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CERTIFICATES, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CERTIFICATE IS NON-FUNCTIONAL OR NON-REDEEMABLE, YOUR SOLE REMEDY, AND MY SOLE LIABILITY, SHALL BE THE HONORING OF A DOCUMENTED REMAINING GIFT CERTIFICATE BALANCE. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS THAT VARY FROM STATE TO STATE.

9. Please note that there is a 3 business-day processing period for gift certificate orders placed online. If ordering during non-business hours (Friday after 5:00 p.m. through Sunday and holidays before 12:01 a.m.) allow up to 96-hours for the certificate to be registered in the database at my office.

10. If your request for a traditional gift card or gift certificate requires immediate assistance or expedited handling, please call Gay Lee Gulbrandson directly at 510.849.1388. Orders must be received by 10 AM Pacific Time for delivery the next business day by 5 PM, via Federal Express. Please note that there is an additional charge for Federal Express delivery and that Federal Express does not deliver to PO boxes. USPS requires 3 days within California.
